FAMILY bASED IMMIGRATION

FAMILY BASED IMMIGRATION

The family-sponsored green card is a highly sought-after route to attaining permanent residency in the United States. However, it's essential to understand that this process is neither simple nor fast, and the waiting periods are frequently lengthy

Immediate Relative Immigrant (IR) Visa

This visa category is given to close family members of U.S. citizens. This specific subcategory is better than other family-based visas because there are no restrictions on the number of visas issued annually and has the quickest processing time. Immediate relatives are categorized as follows:

IR-1: Spouse of a U.S. citizen

IR-2: Unmarried child under 21 years of age of a U.S. citizen

IR-3: Orphan adopted abroad by a U.S. citizen

IR-4: Orphan adopted in the United States by a U.S. citizen

IR-5: Parent of a U.S. citizen who is 21 years of age or older

Family-Based Green Card Processing Times

The processing times for family-based green cards can vary depending on the category of the family member and the specific field office processing the application.

For immediate relatives (spouses, unmarried children under 21, and parents of U.S. citizens) applying from within the U.S., the average processing time is 10.1 months. For sponsors who are green card holders, the average processing time for the I-130 is 25 months

  2. If your family member is outside the USA, the National Visa Center (NVC) will process their application for an immigrant visa. This is called consular processing. Your family member does not need to fill out Form I-485.
